AGREEMENT FOR SINUSSAVER.COM, AND ANY SERVICE OR WEBSITE OWNED BY SINUS SAVER
Please read these Terms of Use carefully before using this site. By using this site, you signify your agreement to these Terms. If you do not agree with any part of these Terms of Use, please do not use this site. Sinus Saver reserves the right, at its sole discretion, to modify, alter, or otherwise update these Terms at any time, and you agree to be bound by such modifications, alterations, or updates.

REFUNDS

Due to the unique and personalized nature of our products, Sinus Saver does not offer refunds under any circumstances. Please choose carefully, as all sales are final.

SHIPPING

Once your order has shipped, Sinus Saver is not responsible for lost, stolen, or damaged or otherwise undelivered shipments. We strongly encourage the use of trackable shipping options to ensure you can monitor your delivery until it arrives safely.

PROPRIETARY RIGHTS

The Sinus Saver website and services (“the Service”) contain proprietary and confidential information protected by applicable intellectual property and other laws. The Service includes information, data, text, software, images, files, and other content and materials owned by Sinus Saver or its affiliates or suppliers, protected by copyrights, trademarks, service marks, patents, and other proprietary rights.

The selection, arrangement, and compilation of the Service’s contents are the exclusive property of Sinus Saver and are protected by U.S. and international copyright laws. All software made available through or used in connection with the Service is the property of Sinus Saver or its suppliers and likewise protected.

Unless otherwise specified, the Service is for your personal, non-commercial use only and is non-transferable. You may not reproduce, duplicate, copy, modify, create derivative works from, frame, distribute, transmit, perform, publish, license, rent, lease, loan, sell, resell, transfer, or exploit any portion of the Service without express authorization from Sinus Saver.

You may view, print, and download materials displayed on or made available through the Service for your personal information—but not for commercial use—and you must not modify or remove any copyright or proprietary notices.

You acknowledge that printing or downloading copyrighted material does not grant you ownership rights; such materials may be subject to additional license agreements and restrictions, which you must comply with. Use of spiders, robots, and similar data-gathering tools is prohibited. All rights not expressly granted herein are reserved.

TRADEMARKS

Sinus Saver, sinussaver.com, our logo(s), and other product and service names are trademarks of Sinus Saver (“Sinus Saver Marks”). The “look and feel” of the Service constitutes proprietary trade dress. You may not reproduce, copy, display, transmit, distribute, modify, or otherwise use the Sinus Saver Marks without prior written permission. Other trademarks appearing on the Service belong to their respective owners.

PRIVACY

Sinus Saver respects your privacy. We generally do not collect personal information automatically from site visitors. However, standard server operation may record certain non-personal visitor information—such as browser type, operating system, and ISP domain—to facilitate optimization of the online experience.

We use this aggregated data for internal review. Personally identifiable information is only known to Sinus Saver when voluntarily submitted and is retained by Sinus Saver. It is not sold or otherwise shared outside the company, though aggregated, non-identifiable data may be shared for marketing or informational purposes. We may use email addresses and other voluntarily submitted contact information to communicate with you for informational purposes (e.g., contest notifications).

All materials on sinussaver.com are provided "as is" without warranties of any kind, express or implied. To the maximum extent allowed by law, Sinus Saver disclaims all warranties, including merchantability and fitness for a particular purpose. We do not guarantee uninterrupted, error-free service, or that defects will be corrected. Sinus Saver is not responsible for any viruses or harmful components.

You (not Sinus Saver) assume the entire cost of all necessary servicing, repair, or correction. Applicable law may limit these disclaimers. The materials on sinussaver.com are provided for educational purposes only. Sinus Saver is not liable for any loss, damage (actual, incidental, consequential, punitive, or otherwise), or injury resulting from the use of content or services offered here.

SUBMISSIONS

Any material (questions, comments, suggestions, ideas, or other submissions) you submit will become the property of Sinus Saver, and we may use it for any purpose, in any media. Sinus Saver is not responsible for visitor-submitted materials. You agree not to submit any libelous, defamatory, privacy-invading, obscene, infringing, or otherwise unlawful content. You also agree to indemnify Sinus Saver and its affiliates against any claims arising from your submission.

EMAIL AND POSTINGS RECEIVED

Do not submit threatening or unlawful content via email or to the site. Sinus Saver will cooperate with law enforcement if required. If accessing sinussaver.com via third-party platforms, applicable guidelines will be enforced.

JURISDICTIONAL ISSUES

Materials on sinussaver.com are presented primarily for audiences in the United States. If you access the site from outside the U.S., you do so at your own initiative, and you are responsible for compliance with local laws. This agreement is governed by the laws of the State of Michigan. Any legal action must be brought in state or federal courts located in Macomb County, Michigan.

SEVERABILITY

If any part of this agreement is deemed unlawful, void, or unenforceable, that part will be severed without affecting the rest of the agreement.

END USER LICENSE AGREEMENT

In addition to these Terms of Use, customers of Sinus Saver’s services are bound by our End User License Agreement (if applicable), which describes the scope of services, content control, ownership, and other terms.

WARRANTY & LIMITATION OF LIABILITY

Sinus Saver provides its services as described and warrants they are free of defects at the time of delivery. Except for that limited warranty, no other warranties apply. In particular, implied warranties of merchantability or fitness for a particular purpose are disclaimed. Sinus Saver disclaims liability for any data loss, service interruptions, unauthorized access, or property infringement. You must monitor and maintain your own content accuracy. Claims must be submitted within thirty (30) days of service performance. Sinus Saver’s liability, if any, is limited to reperformance, fee repayment, or a reasonable allowance, at our discretion. You agree to indemnify Sinus Saver against third-party claims except those covered by the limited warranty.

TERM AND TERMINATION

The initial term is one (1) year from the effective start date. You may renew by paying renewal fees in advance. Either party may terminate upon written notice if the other breaches any material term and fails to cure within fifteen (15) days. For pre-designed templates (if applicable), a refund may be available within 30 days, less costs. No refund is available for custom work.

PRICE AND PAYMENT

Fees are due upon presentation and must be paid in advance for the initial term and any renewals. Payments are nonrefundable unless otherwise stated in promotions or as noted above.

ANTI-SPAM POLICY

Sinus Saver prohibits use of the Service for sending spam. You may not send unsolicited bulk email through our systems. All email must comply with legal and technical standards, including accurate headers and subject lines. Harvesting email addresses is prohibited. Violation may result in immediate account termination and legal liability under laws such as the CAN-SPAM Act of 2003.
